1. Acceptance of Terms

By accessing and using OpnFundr ("the Platform"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Description of Service

OpnFundr is a donation platform that allows users to create projects and receive donations via direct payments. OpnFundr is NOT a crowdfunding investment platform and does not facilitate equity investments or promise returns on contributions.

3. User Accounts

To create a project on OpnFundr, you must register for an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and truthful information
  • Updating your information to keep it current

4. Project Creation

When creating a project, you agree to:

  • Provide honest and accurate descriptions of your project
  • Not misrepresent the purpose or use of donations
  • Comply with all applicable laws and regulations
  • Not use the Platform for fraudulent or illegal activities
  • Be solely responsible for the fulfillment of your project

5. Donations

All contributions made through OpnFundr are donations and not investments. Donors should understand that:

  • Donations are voluntary and non-refundable
  • There is no guarantee of project completion
  • No financial returns or rewards are promised or guaranteed
  • Project creators are not legally obligated to provide returns

6. Payment Processing

We use Stripe for payment processing. By using the Platform, you agree to Stripe's terms and conditions. OpnFundr is not responsible for payment processing errors or disputes.

7. Fees

OpnFundr charges a flat 5% platform fee on all donations to maintain and improve the service. Payment processing fees of 2.9% + $0.30 per transaction are charged by our payment processor, Stripe. Both fees are deducted from the donation, and the remainder is credited to the project creator.

  • Platform fee: 5% of the donation amount
  • Payment processing: 2.9% + $0.30 per transaction
  • Example: a $100 donation results in $91.80 to the creator ($5.00 platform fee + $3.20 payment processing)
  • Donors may optionally choose to cover the fees at checkout, in which case the creator receives the full donation amount
  • Donations funded from a pre-funded OpnFundr wallet balance are charged the 5% platform fee only, as processing was already paid at top-up

8. Prohibited Activities

You may not use the Platform to:

  • Promote illegal activities or scams
  • Infringe on intellectual property rights
  • Harass, abuse, or harm others
  • Distribute malware or harmful code
  • Manipulate or game the system
  • Violate any applicable laws or regulations

9. Content Rights

You retain ownership of content you post but grant OpnFundr a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on the Platform.

10. Termination

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity. Users may close their accounts at any time by contacting support.

11. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

  • Project completion or success
  • Accuracy of project descriptions
  • Availability or uptime of the Platform
  • Security of data transmission

12. Limitation of Liability

OpnFundr shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Platform.

13. Governing Law

These terms are governed by the laws of the jurisdiction in which OpnFundr operates.

14. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified terms.
