1. Acceptance of Terms

By accessing and using OpnFundr ("the Platform"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Description of Service

OpnFundr is a donation platform that allows users to create projects and receive donations through multiple channels including direct payments, sponsored videos, and promised donations. OpnFundr is NOT a crowdfunding investment platform and does not facilitate equity investments or promise returns on contributions.

3. User Accounts

To create a project on OpnFundr, you must register for an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and truthful information
  • Updating your information to keep it current

4. Project Creation

When creating a project, you agree to:

  • Provide honest and accurate descriptions of your project
  • Not misrepresent the purpose or use of donations
  • Comply with all applicable laws and regulations
  • Not use the Platform for fraudulent or illegal activities
  • Be solely responsible for the fulfillment of your project

5. Donations

All contributions made through OpnFundr are donations and not investments. Donors should understand that:

  • Donations are voluntary and non-refundable
  • There is no guarantee of project completion
  • No financial returns or rewards are promised or guaranteed
  • Project creators are not legally obligated to provide returns

6. Payment Processing

We use Stripe for payment processing. By using the Platform, you agree to Stripe's terms and conditions. OpnFundr is not responsible for payment processing errors or disputes.

7. Fees

OpnFundr charges a 10% platform fee on all donations and ad revenue to maintain and improve the service. This means project creators receive 90% of all funds raised. Additionally:

  • For donations under $5: Standard payment processing fees (2.9% + $0.30) are passed to the donor in addition to the 10% platform fee
  • For donations $5 and above: OpnFundr absorbs the payment processing fees, so donors only pay the 10% platform fee
  • For sponsored videos and promised donations: Only the 10% platform fee applies (no payment processing fees)

8. Sponsored Content

Sponsored videos are provided by our advertising partners. When supporters watch optional sponsored videos, they unlock access to project updates and help support projects. Project creators receive 90% of sponsored content value, with 10% retained as the platform fee. We make reasonable efforts to accurately track and allocate sponsored content value to projects.

9. Prohibited Activities

You may not use the Platform to:

  • Promote illegal activities or scams
  • Infringe on intellectual property rights
  • Harass, abuse, or harm others
  • Distribute malware or harmful code
  • Manipulate or game the system
  • Violate any applicable laws or regulations

10. Content Rights

You retain ownership of content you post but grant OpnFundr a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on the Platform.

11. Termination

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity. Users may close their accounts at any time by contacting support.

12. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

  • Project completion or success
  • Accuracy of project descriptions
  • Availability or uptime of the Platform
  • Security of data transmission

13. Limitation of Liability

OpnFundr shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Platform.

14. Governing Law

These terms are governed by the laws of the jurisdiction in which OpnFundr operates.

15. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified terms.
